LEGAL TERMS, SERVICE AGREEMENT & PRIVACY POLICY

1. MASTER SERVICE AGREEMENT & INFORMED CONSENT

This section applies to all Consult/Discovery Calls, Somatic Support, Embodied Processing (EP), and TRE® services.

SCOPE OF PRACTICE & DISCLAIMERS

  • Educational Purpose: I understand that TRE® and Somatic Support are provided for relaxation, autonomic nervous system regulation, and stress/tension reduction.

  • Not Medical/Psychiatric Advice: Evan Ritter is not a medical professional, licensed therapist, or psychiatrist. TRE® is not a substitute for medical treatment or diagnosis.

  • FDA Disclaimer: These modalities have not been evaluated by the FDA or AMA and are not intended to diagnose, treat, cure, or prevent any disease.

  • Personal Responsibility: The practitioner will prioritize my safety and comfort, but it is ultimately my responsibility to go at a pace that is best for my body. I am participating at my own risk.

PRECAUTIONS & MEDICAL CLEARANCE

By agreeing to these terms, I verify that I am not pregnant (and there is no chance I could be). I understand that if I have (or have had) any of the following conditions, I have both notified the practitioner and received medical approval to proceed:

  • Irregular Blood Pressure / Heart Conditions (Surgery, Pacemakers, etc.)

  • Physical Limitations (Recent operations, broken bones, chronic eye/neck/back conditions)

  • Hypo/Hyperglycemia (on medications)

  • Chronic Illness (Fibromyalgia, CFS, POTS, MCAS, Lyme)

  • Epilepsy

  • Severe PTSD / C-PTSD

  • Bi-polar / Schizophrenia / Psychosis / Borderline / Dissociative Disorders

  • Concussion / Head or Brain Injuries

The practitioner reserves the right to refuse or cancel sessions without refund if these apply and prior medical approval was not confirmed.

CONFIDENTIALITY & DATA

Information shared will be kept confidential unless a written release is signed, or if disclosure is required by law. I consent to the storage of my data as outlined in the Privacy Policy below.

2. CANCELLATION & REFUND POLICY

  • Private Sessions: May be rescheduled up to 48 hours in advance. Cancellations or rescheduling with less than 48 hours’ notice will be charged in full.

  • Group Sessions (TRE®): Cancellations with more than 7 days’ notice receive a 50% refund. No refunds are provided for cancellations within 7 days of the session start.

  • General: No refunds are issued for missed appointments, if you choose to stop partway through a session, or if you fail to disclose medical precautions. If the practitioner cancels for unforeseen reasons, a full refund will be made.

3. WEBSITE TERMS OF USE

Agreement: Using https://mountainandmeadowhealth.com/ binds you to these terms. You must be 18+. Intellectual Property: All content (TRE® instructions, videos, text) is owned by Mountain and Meadow Health, LLC. Dispute Resolution: Any disputes will be handled through informal negotiations for 30 days, followed by binding arbitration in the State of Pennsylvania.

4. SCOPE OF LEARNING & LIABILITY WAIVER

  • Personal Use Only: I am learning TRE® for my personal use. This is not a certification. I am not qualified to teach others.

  • Indemnification: If I teach TRE® to others, I accept full liability and release Evan Ritter, Mountain and Meadow Health, LLC, TRE® LLC, and Dr. David Berceli from all claims.

  • Release of Liability: I release Evan Ritter, Mountain and Meadow Health, LLC, TRE® LLC, and Dr. David Berceli from any legal, financial, and medical liability except in cases of gross negligence.

5. PRIVACY POLICY

We collect names, emails, and health data voluntarily provided. Health data is handled with strict privacy standards. We use Stripe/PayPal for payments; we do not store your credit card numbers. You have the right to request data deletion at any time.
